This month, two critical legal battles between multinational pharmaceutical companies and the Indian government are taking center stage in an ongoing struggle over India?s medicines patent law. The potential consequences could be dire for governments and people in developing countries that rely on affordable, quality generic medicines produced in India. For example, more than 80% of antiretrovirals (ARVs) used by donor funded HIV treatment programmes globally between 2003 and 2008 were sourced from generic manufacturers in India. [1]

At stake are public health safeguards within India?s patent law that allow India to provide life saving drugs at affordable prices. One case goes to the heart of what merits a patent. The other addresses what countries can do when patented life saving medicines are priced out of reach for the vast majority of patients.

India?s 1970 Patents Act was a watershed law designed to encourage the development and production of low-cost generic medicines. Over time, it helped India become the ?pharmacy of the developing world,? with generic manufacturers competing for markets and thereby dramatically driving down prices of medicines that were patented elsewhere. For example, the cost of first generation HIV treatment dropped from over $10,000 per patient per year in 2000 to $350 by 2001. Today, improved first line treatment costs roughly $120 yearly. [2]

By joining the World Trade Organization in 1995, India became obligated to start granting pharmaceutical patents within a decade. But in 2005, the country adopted a strict medicines patent law that, while ensuring patent protection for new pharmaceutical compounds, makes it tougher to get a patent on new forms of existing medicines. The law was designed with the social objective of stopping drug giants from indulging in ?evergreening,? a common abusive patenting practice in the pharmaceutical industry aimed at filing and then obtaining separate patents relating to different aspects of the same medicine.

This tougher patentability standard?Section 3d of India?s patent law?is at the crux of Swiss company Novartis? six year legal battle against the Indian government, which has now reached India?s Supreme Court. Novartis is contesting the Indian patent office?s and appellate body?s decision to reject the company?s application for a secondary patent on the salt form of imatinib, a life saving drug for treating chronic myeloid leukemia. (The basic research that led to the original drug was conducted largely in publicly funded US research institutions. [3])

Novartis is arguing that the interpretation of Section 3(d) as applied by the courts and patent office is narrow and should be broadened, in this case, for example, to allow patenting of the mesylate salt form of imatinib on the basis of a 30% increase in bioavailability. But this reasoning is flawed, according to patient and public interest groups. Selecting a particular salt of an active ingredient as a means of improving bioavailability is a common practice within the pharmaceutical industry, and should not be considered patentable.

A win for Novartis would set a dangerous precedent, severely weakening India?s legal norms against evergreening and inevitably leading to patents being granted far more widely in the country. Filing patent applications covering simple changes in the chemistry or formulation of existing pharmaceutical products is a lucrative game for the pharmaceutical business, but also a deadly one for patients: it would prevent generic competition for these products and allow pharmaceutical companies to continue charging high prices, which can mean the difference between life and death.

The second case now playing out in India?s courts revolves around the issue of ?compulsory licensing,? a legal mechanism sanctioned by international trade law that allows governments to authorise production of a medicine by a company other than its patent holder, in the interest of public health. In March 2012, India?s Patent Controller took the unprecedented step of issuing a compulsory license to an Indian generic manufacturer: with German pharmaceutical company Bayer charging $5,500 per person per month in India for a kidney and liver cancer medicine (sorafenib tosylate, marketed as Nexavar), the Indian government deemed this price unaffordable and granted a compulsory license to generic manufacturer Natco. As a result, a generic version is now available for 97% less ($175/month).

India has faced political backlash from the US for this landmark move, one which health advocates and patients worldwide hope will set a precedent for other life-saving medicines deemed unaffordable. For example, unlike first-generation ARVs, several of the newest HIV medicines?needed by patients who have become resistant to their drug regimens?are patented in India, preventing generic competition. One of them is the integrase inhibitor raltegravir, which M?decins Sans Fronti?res (MSF) uses in its Mumbai clinic to treat people who developed resistance to two drug regimens, at a cost of $1,750 per person/year?for just one drug of a needed triple drug cocktail.

Bayer has appealed India?s granting of a compulsory license, and the case is now with the country?s Intellectual Property Appellate Board?and may, like the Novartis case, eventually reach India?s highest court. The world is watching closely, as these cases could have a profound impact on access to life saving medicines for millions of people worldwide.

LG Display countersues Samsung over OLED patent infringement

The strained relationship between the two tentpoles of Korea's tech industry is starting to wear, now that LG Display has counter-sued its local rival over OLED patents. Earlier this month, Samsung filed for an injunction accusing its frenemy of stealing secrets, but LG is claiming instead that it's the victim. If successful, Lucky Goldstar would seek a ban on devices including the Galaxy S III, Galaxy Tab and Galaxy Note on the pair's home turf -- so, yeah, this one looks like it's going to run and run.

Myanmar's reformist president asks world to see his country in a new light

Myanmar's president on Thursday called on the world to take a fresh look at his Southeast Asian nation as it undertakes reforms, emerges from decades of authoritarianism, poverty and isolation and sheds its former pariah status.

President Thein Sein told the U.N. General Assembly that sweeping changes in Myanmar - the freeing of hundreds of political prisoners, fair by-elections, ending media censorship - have created "a new political culture of patience and dialogue."

The 67-year-old former general and former military junta member has emerged as the unlikely catalyst for a wave of reforms that were unthinkable a year ago in the former British colony also known as Burma.

"The political progress in our country is enhancing its political legitimacy. This, in turn, facilitates the creation of basic political stability, thereby paving the way for economic and social transformation necessary for (a) better living standard of the people," Thein Sein said through a translator.

Thein Sein's reformist, quasi-civilian government took office in March 2011, ending five decades of military rule in Myanmar and ushering in broad changes.

"To complete this process, we certainly need the understanding and support from the United Nations and its member states, the international community as a whole and, last but not least, the people of Myanmar," Thein Sein added.

He said Myanmar's political and economic reforms, as well as its efforts to wind down decades-old wars with ethnic groups, justify viewing the country in a new light.

"At the same time, it is equally important that Myanmar should be viewed from a different and new perspective," Thein Sein said.

Myanmar's changes have drawn positive responses from the United States and the European Union, who began unwinding economic sanctions that barred most trade and investment in the country and upgrading diplomatic relations.

Clinton meeting

On Wednesday, Secretary of State Hillary Clinton told Thein Sein that the United States would take further steps to ease the U.S. ban on imports from Myanmar, a move that would help his government draw investment and create jobs for the country's 60 million people.

Thein Sein said that of Myanmar's 11 major ethnic conflicts, the government has signed ceasefire agreements with 10 armed groups and was committed to pursuing peace talks in the conflict with the Kachin Independence Army that erupted again in June 2011.

"We believe that cessation of all armed conflicts (is) a prerequisite for the building of genuine democracy," he said.

"We consider any loss of life and property from either side in the armed conflict as a loss for the country," he added.

Clinton's New York meeting on Wednesday with Thein Sein - their third face-to-face encounter in less than a year - came a week after she met veteran Myanmar pro-democracy leader Aung San Suu Kyi in Washington, where the Nobel Peace laureate was awarded the highest congressional medal of honor.

Suu Kyi, who was kept under house arrest for 17 years, was released and subsequently elected to parliament in April, and has urged the United States to ease sanctions to support the reform process.

ARLINGTON, Texas (AP) - The Oakland Athletics have set an American League record for striking out the most in a season.

Chris Carter's strikeout in the second inning Wednesday night at Texas was the team's third of the game and 1,325th this season, one more than the Tampa Bay Rays had in 2007. The A's quickly added to that total when Brandon Moss followed with an inning-ending K.

Oakland already had four strikeouts through two innings, but also had a 5-3 lead at that point against the AL West leaders.

The A's, who have seven games left after Wednesday night, already surpassed their previous strikeout total by more than 100. They had 1,226 in 2008.

FORM 1 delivers high-end 3D printing for an affordable price, meets Kickstarter goal in 1 day

A $2,300 3D printer isn't really anything special anymore. We've seen them as cheap as $350 in fact. But all those affordable units are of the extrusion variety -- meaning they lay out molten plastic in layers. The FORM 1 opts for a method called stereolithography that blasts liquid plastic with a laser, causing the resin to cure. This is one of the most accurate methods of additive manufacturing, but also one of the most expensive thanks to the need for high-end optics, with units typically costing tens-of-thousands of dollars. A group of recent grads from the MIT Media Lab have managed to replicate the process for a fraction of the cost and founded a company called Formlabs to deliver their innovations to the public. Like many other startups, the group turned to Kickstarter to get off the ground and easily passed its $100,000 within its first day. As of this writing over $250,000 had been pledged and the first 25 printers have already been claimed.

The FORM 1 is capable of creating objects with layers as thin as 25 microns -- that's 75 percent thinner than even the new Replicator 2. The company didn't scrimp on design and polish to meet its affordability goals either. The base is a stylish brushed metal with the small build platform protected by an orange plastic shell. There's even a companion software tool for simple model creation. You can still get one, though the price of entry is now $2,500, at the Kickstarter page. Stocks snap a losing streak

(AP) ? Stocks notched their first gain of the week Thursday after Spain announced severe budget cuts intended to convince the world that it can meet deficit-reduction targets.

It was the best day for the U.S. market since Sept. 13, when Federal Reserve Chairman Ben Bernanke announced further steps by the central bank to speed the economic recovery.

Stocks were also helped by speculation that the central bank of China will act soon to help the world's No. 2 economy.

The Dow Jones industrial average climbed 72.46 points, or 0.5 percent, to close at 13,485.97. It was the Dow's first gain in five trading sessions. The average was up as much as 109 points after the Spain announcement.

The Standard & Poor's 500 index, after five days of declines, closed up 13.83 points, or just shy of 1 percent, at 1,447.15. The Nasdaq composite index rose 42.90 points to 3,136.60.

The Nasdaq and S&P were helped by a jump in Apple stock, reversing three days of declines. Apple gained $16.14, or 2.4 percent, to $681.32 despite an analyst's report reducing estimates for shipments of iPhones later this year.

As fear grew that Spain will need an international bailout, the finance minister said a draft budget for 2013 cuts overall spending by ?40 billion, or about $51 billion. He said cuts for ministries would average almost 9 percent.

The cuts are meant to show world investors and other countries that Spain can meet fiscal targets. The budget unveiling, shortly before noon EDT, lifted the U.S. stock market from what had been only modest gains.

"That's the only major thing that's happened," said Dan Greenhaus, chief global strategist for the brokerage BTIG. "It's an excuse to rally the stock market."

Technology stocks and energy companies made the biggest gains. Utility stocks, which tend to do well when investors are fearful, were the only industry group in the S&P to fall.

The market gains started earlier, in Asia, helped by expectations that the People's Bank of China will act soon. China's biggest steelmaker said Thursday it has shut down a mill in Shanghai, a sign of weakening growth.

Stocks rose 0.5 percent in Japan and 1.1 percent in Hong Kong.

In the United States, investors grappled Thursday with mixed economic data:

? The economy grew at an annual rate of 1.3 percent from April through June, the government said, slower than the previous estimate of 1.7 percent and not nearly fast enough to reduce unemployment.

? Demand for long-lasting manufactured goods plunged in August by the most since January 2009. That was mostly because of a huge drop in commercial aircraft orders, which are volatile. Orders that reflect business investment rose solidly.

? The number of Americans seeking unemployment benefits fell 26,000 last week to 359,000, the lowest figure in nine weeks. A figure consistently below 375,000 is generally enough to lower the unemployment rate.

? The number of Americans who signed contracts to buy previously occupied homes fell in August from a two-year high in July. The National Association of Realtors' sales index is still 10 percent higher than it was a year ago.

In Europe, stocks came back from one of their worst days in months. The benchmark stock index finished 0.7 percent higher in France and 0.2 percent higher in Germany and Britain.

Borrowing costs for financially troubled Spain and Italy also edged down, a positive sign.

In the U.S., demand for government bonds fell, generally an indication that investors are more willing to embrace risk. The yield on the 10-year note, which moves opposite the price, rose 0.03 percentage point to 1.65 percent.

The price of crude oil rose $1.87 per barrel to $91.85 as concerns mounted about a potential military confrontation over Iran's nuclear program. Oil had dropped $9 a barrel in two weeks.

Israeli Prime Minister Benjamin Netanyahu warned at the United Nations that Iran will have enough enriched uranium to make a nuclear bomb by next summer and urged the world to draw a "red line" to stop it.

The dollar fell against the euro and pound but rose against the yen.

Among other U.S. companies making moves:

? Tempur-Pedic International, the mattress company, climbed $3.86, or 14.4 percent, to $30.64 after announcing it would buy a rival, Sealy, for about $229 million in cash.

? Discover Financial Services rose $2.69, or 7.3 percent, to $39.71. It reported a slight earnings decline in its latest quarter but beat Wall Street expectations. It also said credit card use increased and more customers paid off cards on time.

? GE hit a four-year high after the company told analysts it expects industrial revenue to rise about 10 percent this year. GE gained 63 cents, or 2.9 percent, to $22.73 in afternoon trading. They rose as high as $22.86.

Fall is officially here and we're closing in on the final quarter of 2012, a time when products usually get real or fade into the vapor forever. One that we've been waiting to hear about just got a little more real as the Verizon Media Server (VMS), which Big Red teased last December and promised in 2012, got a little mention in the company's latest comments to the FCC. While attempting to persuade the FCC to standardize an IP content interface and delay the December 2012 deadline, Verizon revealed that the rollout of its new product will begin in the coming months. The full feature set of this server is still unknown, but one interesting feature is its ability to stream multiple high-def stream simultaneously to 3rd party devices connected to your home network. Of course without a industry wide streaming standard -- again, like Verizon is requesting the FCC to ratify -- who knows exactly what devices could be in the mix.

Syria rebels say launch "decisive battle" in Aleppo

BEIRUT (Reuters) - Syrian rebels said they had launched a major attack in Aleppo on Thursday at the start of a "decisive battle" to push President Bashar al-Assad's forces out of the country's biggest city.

Heavy fighting was reported in around 14 districts by opposition activists and several rebel brigades, though the scale of the fighting could not be confirmed independently.

A video posted on YouTube by rebels showed Abdulqadir al-Saleh, the head of the biggest rebel force in Aleppo, the Tawheed Brigade, carrying a walkie talkie and announcing the start of the assault.

"Now the attack on Assad's forces has started on all fronts and God willing today will be decisive in Aleppo," he said.

The 18-month-old uprising against Assad has killed 30,000 people and the violence is escalating sharply, say activists. World powers are meeting at the United Nations but are divided over the crisis, which has descended into civil war.

The U.N. refugee agency said up to 700,000 Syrian refugees may flee the country by the end of the year, nearly quadrupling its June forecast for the exodus from the deepening crisis.

Around 294,000 refugees have crossed into neighboring Jordan, Iraq, Lebanon and Turkey, most of them in the last two months.

"This is a significant outflow taking place, 100,000 people in August, 60,000 in September and at the moment 2,000 or 3,000 per day or night," Panos Moumtzis, Regional Refugee Coordinator for UNHCR, said on Thursday in Geneva.

The flow of refugees surged in August when Assad deployed jets and helicopters to strike rebel-held towns in the northern provinces of Aleppo and Idlib, sending thousands across the border with Turkey.

"ZERO HOUR"

Rebels flooded into Aleppo two months ago but have been held back by low ammunition and the army's superior firepower.

Insurgents from many brigades in Aleppo said "zero hour" had been announced by calls of Allahu Akbar ("God is greatest") from mosques at 4 p.m. (1300 GMT) on Thursday. They said there were clashes in the heart of the city, including the Hamidiya and Midan districts.

Tawheed Brigade Spokesman Abu Firas said all the battalions working in Aleppo "from the small ones that consist of ten people to the big ones" had met to agree on the offensive two days ago.

The British-based Syrian Observatory for Human Rights, a violence watchdog with a networks of activists in the country, said hundreds of insurgents were taking part in heavy fighting and the government was responding with heavy artillery.

Aleppo is split roughly in half, with rebels in the east and government forces and local Assad-loyal militia in the west.

Syria's rebels are a mixture of army defectors, Islamists and civilians who have taken up arms against Assad.

Some groups have been accused of human rights abuses and western powers who call for Assad's removal are reluctant to support the disparate fighters. Western diplomats say they are looking for a clear command structure and coordination among rebels.

"STAIN ON U.N."

World leaders meeting at the United Nations have expressed concern at the violence but are deadlocked over their response to the conflict, which pits mainly Sunni Muslim rebels against Assad, who is from an Alawite minority close to Shi'ite Islam.

Qatar, one of several Sunni Muslim powers which supports the rebels, called for a no-fly zone to provide a safe haven inside Syria. French President Francois Hollande also called on the global body to protect what he called "liberated zones" under rebel control.

But there is little chance of securing a Security Council mandate for such action given the opposition of veto-wielding members Russia and China.

Russian President Vladimir Putin said in Moscow on Wednesday any attempt to use force unilaterally or interfere with events in the Middle East would be counterproductive. China's Foreign Minister Yang Jiechi said the destiny of the region "should be held in the hands of its own people".

Turkish Prime Minister Tayyip Erdogan said on Thursday Russia, China and Iran's stance on Syria was letting a massacre go on unabated.

Activists said more than 300 people died on Wednesday, making it one of the bloodiest yet. They said 55 people had been killed in rural areas around Damascus, including at least 40 who appeared to have been executed in the town of al-Dhiyabia, southeast of the capital.

The Observatory also said 14 people had been killed in a rebel bomb attack on a military command centre in Damascus and in a prolonged gun battle between rebels and members of the security forces.

The Islamist militant group Al Nusra Front claimed responsibility on Thursday for the assault, saying it was carried out in two stages, starting with a suicide bomber detonating a car near the building.

Rebels have also targeted Assad's inner circle during the conflict. The president's widowed sister Bushra has moved to the United Arab Emirates, a source close to the UAE government said on Thursday, apparently having fled with her children after her powerful husband was killed.

Bushra al-Assad, Bashar's older sister, was married to Assef Shawkat, the former deputy defense minister who was killed in a bomb attack in Damascus on July 18.

Tips: How to protect yourself from financial abuse, coerced debt

Knowledge is power if you're a victim of coerced debt.

Victims of this form of financial abuse, which studies have found can coincide with domestic violence, often are blindsided when they learn their abuser has run up tens of thousands of dollars in unpaid debt in their name, ruining their credit in the process.

If you're suspicious of what's going on, you need to monitor your financial affairs. But that can be a challenge if you're still living with your abuser.

Domestic violence victims, what to do when financially abused

Laura Russell, supervising attorney with The Legal Aid Society in New York, cautions, "Whatever she does, she has to do it safely." She suggests going to the local library to do your digging so there's no record on your home computer.

You're entitled to a free credit report from the three main credit reporting agencies each year at AnnualCreditReport.com, so Russell suggests pulling a different report every four months to make sure there are no credit cards you're not aware of, and no missed payments, under your name.

Also check bank accounts and county records to make sure your name is on the deed to your home, she says.

While it may be hard to imagine that your spouse or partner has stolen your identity, in reality it's not uncommon. ?

Nikki Junker, victim adviser and social media manager with the nonprofit Identity Theft Resource Center, often advises domestic violence victims. Her first suggestion is to take out a restraining order against your abuser.

Then file a police report that your identity has been stolen and report credit cards that have been taken out in your name. "Leave a legal trail," she says.

Other important steps are:

  • Putting a on your credit report. Contact one of three main credit bureaus -- Experian, Equifax or TransUnion. If you contact one, they're required to contact the other two.
  • Calling and notifying banks and credit card companies about fraudulent activity and close accounts.
  • Putting a , if your state allows it. That restricts access to your credit report, unless you temporarily lift it, making it tough for your partner to open a new account in your name.
  • Opening a post office box to prevent your abuser from getting his hands on credit card offers sent to you.
  • Changing PIN numbers and passwords associated with your accounts.
  • Considering requesting the Social Security Administration to change your Social Security number.

(AP) ? A Russian tycoon who has financed a newspaper critical of the Kremlin and supported the opposition has been charged with hooliganism and assault for punching a businessman during a television talk show. He dismissed the criminal case as politically motivated.

Russia's top investigative agency, which announced the charges Wednesday, said the defendant, Alexander Lebedev, cannot leave Moscow while the probe is under way. In Russia, filing charges marks the start of a criminal investigation, which may or may not lead to a trial.

Lebedev said in comments carried by the Interfax news agency that he considers the charges against him political and "completely made up."

He could face up to seven years in prison, if he's convicted on hooliganism charges similar to those that were filed against three members of the feminist rock band Pussy Riot. They were sentenced to two years each last month for performing a "punk prayer" against President Vladimir Putin in Moscow's main cathedral.

The charges refer to a September 2011 incident when Lebedev punched property developer Sergei Polonsky during a TV discussion of the financial crisis, sending him tumbling to the ground.

After the recording, Polonsky complained he had sustained a hand injury and that his jeans were ripped. According to the charges, however, an expert medical opinion dated Aug. 31 determined that Polonsky also received bruises to his hips and face that he did not realize were harmful at the time.

Russia's hooliganism statute also requires proof the accused grossly violated social norms. Though Polonsky began the exchange by pointing at Lebedev and saying "I just feel like whacking somebody in the face right now," the charges assert he was not referring to anyone in particular and that Lebedev was "motivated by political hatred."

A few days after the incident, Putin referred to the fight as "hooliganism," and a criminal investigation was launched in October. Putin has taken an increasingly tough course against dissent after massive protests against his rule last winter, with searches and interrogation of opposition activists and the passage of repressive bills.

Lebedev, whose net worth was reported by Forbes magazine to be $1.1 billion, made his money in the banking industry. He has financed the Novaya Gazeta newspaper, which is fiercely critical of the Kremlin, and the British papers the Independent and the Evening Standard.

Lebedev's son, Yevgeny, who owns the two British publications, tweeted that his father is "being targeted by people who don't like his stance against corruption, and hate Novaya." He later described the charges as "extraordinarily disproportionate."

"My father has been targeted because of his determination to fight against corruption and to be a crusader for democracy in a country where this has not always been welcome," Lebedev's son said in a statement. "I really hope that this does not presage a new phase of crackdowns on those who speak out against injustice."

The tycoon had said last month that he was being forced to sell his assets because of pressure by Russia's Federal Security Service, the main KGB successor agency. He said the pressure was rooted in corruption investigations by Novaya Gazeta, alleging that some of the service's officers were involved in corruption.

Lebedev and former Soviet leader Mikhail Gorbachev own a 49 percent stake in the newspaper, while the remaining shares are controlled by Novaya's staffers.

Novaya Gazeta's relentless criticism of the Kremlin, and its investigations into official corruption, have put many of its journalists under fire. Four of the paper's reporters have been killed since 2000, including Anna Politkovskaya, a fierce critic of the Kremlin and its policies in Chechnya. She was gunned down in the elevator of her Moscow apartment building in 2006. Others have been harassed and physically attacked.

Lebedev has also supported Alexei Navalny, a charismatic anti-corruption crusader and blogger who was a key driving force against massive protests last winter against Putin's rule. Lebedev, a KGB veteran like Putin, so far has avoided blaming the president for his woes, pointing the finger at security services for the campaign against him.

Lebedev's lawyer, Genri Reznik, told Interfax that the newly announced charges come as a "punishment for Lebedev's social activities, his fight against corruption, his funding of an opposition newspaper and support for Navalny."

Lebedev owns the National Reserve Bank and has a stake in Russian flag carrier Aeroflot as well as his own Red Wings airline.

iPhone 5 Will Benefit Business... Eventually

The arrival of Apple's iPhone 5 is a source of much joy for many consumers who long to get their hands on the latest gadget from Cupertino. But right now it might be causing some some headaches for businesses dealing with some half-baked software and potential jumps in their data bills.

Missing in Action

ReadWriteWeb has already covered the ground with Apple's "upgraded" Maps app, which cut the cord with Google Maps data to deliver what can only be described as a sub-optimal experience.

But the problems with Apple's Maps app go deeper than just a bit of inconvenience for end users who want to find the nearest grocery store. It's also a kick in the bottom line for the grocery store owners - and other businesses - who may not be listed on Apple's source of business information, Yelp. Any business listed on Google Maps and not accurately listed on Apple's Maps app stands to lose quite a bit of foot traffic to their establishment.

And there are a lot of potential walk-ins affected. According to The New York Times, "even though Android phones far outnumber iPhones? iPhone users account for almost half of mobile traffic to Google Maps."

Serious Implications

It's not just retail businesses missing, either. The site GottaBeMobile ran a search for emergency rooms in San Francisco and found it very lacking.

"Searching for an emergency room with an iPhone 5 brings up private medical offices, pharmacies and just about anything else medical related that?s not a hospital or emergency room. Need a concierge house doc? Sure, he?s mapped, but [San Francisco] General Hospital is missing in action. That pediatrics emergency room? It?s there, but it isn?t marked properly," the site reported.

A similar search for hospitals in my city revealed a starting discrepancy. One of the two facilities was correctly listed, but the other is sited at its old location, which closed in 2009 when the hospital relocated to a new facility. The new facility is completely invisible, both in search results and on the standard map labels itself. (Curiously, Yelp itself has the proper location listed correctly.)

Getting A Pass

Passbook is another new iOS 6 feature that's promises a channel for businesses to reach users, and the initial reviews on it aren't too glowing, either.

The problem seems to be two-fold right now. Applications have to be upgraded to support Passbook, and many business app developers are still in the process of upgrading their products to accommodate this support. Starbucks, it has been reported, is one of the businesses preparing to add Passbook support to its app.

The other side of the equation is end-user education. There are anecdotal reports of the Passbook being difficult to figure out and then, in some cases, not working correctly.

Unlike the Maps issue, though, this is something that businesses should be able to control. First, there's improving or creating a Passbook-supported app. After that, getting customers trained on how to use the app to connect with Passbook should be factored in to the use equation. This is less than ideal, and some analysts are calling Apple to task for not making sure the process was easier to manage. But this is incremental business we're talking about now, not losing existing customers or marketing channels.

LTE Sticker Shock

The addition of 4G LTE capabilities on the new iPhone will bring end-users the ability to download a lot of content in a short amount of time. And that could mean some significiantly bigger data bills at the end of the month. For businesses footing the mobile bills for their employees, the impact on the bottom line could be dramatic - especially as carriers continue to phase out unlimited data plans.

In the short-term, it's very likely that businesses will see bigger charges on many employee's accounts, as they go a little crazy with all that cool data that's to be had so quickly. It may not be too much of a surprise: any IT department that was already managing LTE-capable Android phones will no doubt have effective policies in place for dealing with data hogs.

The good news is, this increase in cost may only be a temporary phenomenon. By next year, all of the major carriers in the US will have LTE capability, which could start a price war among carriers seeking to differentiate. And the iPhone 5's presence on LTE should give the carriers a swift kick to continue to expand their LTE coverage.

Darkest Before The Dawn

All of these business issues with the iPhone 5 share a common theme: they are all troublesome in the short-term, but in the longer view they may turn out to be of real benefit to businesses.

A more accurate Maps app (as it gets filled in with better data), a more complete Passbook that lets businesses do mobile transactions and cheaper LTE service will ultimately be very good things for businesses seeking to reach customers and keeping their employees connected.

Apple is making some risky bets here, but if they can survive the short-term hiccups, companies stand to do very well with the iPhone 5.

Now we know why the skinflint rich hate Obamacare:

Most Americans pay more in payroll taxes ? which finance Social Security and Medicare ? than they do in income taxes. The rich are different.

Mitt and Ann Romney paid virtually no payroll taxes in 2011, because nearly all their income came from investments on which payroll tax was not owed.

For most taxpayers, the 2.9 percent Medicare tax levied on wage income will be the same next year as it was in 2011. But starting in 2013, high-income taxpayers will pay more ? and in the Romneys? case ? much more.

Married taxpayers with income over $250,000 will pay a 3.8 percent Medicare tax rate on income over that amount, and all income will be covered, including the capital gains that make up most of the Romneys? income.

If their 2013 income were unchanged from this year, their Medicare tax bill would exceed $500,000.

That tax was passed as part of the health care bill enacted by Congress and signed by President Obama in 2010 ? a law known as ?Obamacare.? Mr. Romney has pledged to seek repeal of that law.


Let's lift the cap on social security too,while we're at it. After all, if a man is so rich that he he can earn many millions while running for president --- so many millions that he was able to "over-contribute" as a PR stunt, then he can easily afford to put more money into the safety net. In fact, he won't even feel it.

Oh, and also. This seems to be a good time to clear up the confusion about Rafalca the dressage horse. Like may others, I erroneously said the other day that the Romney's got a $77,000 deduction for the horse. That's wrong. As this thorough Forbes piece spells out, they haven't actually gotten it yet. It's a deferred deduction. This deferral is very complicated. I don't think it will be something you'll find on Turbo Tax as an option to pay for your quilting hobby, but wealthy people like the Romney's have high paid tax lawyers to do that for them.
